The Special Education Section posts notices of any rulemaking activities that are specific to possible rule changes to state special education rules.
We invite and encourage participation in the rule making process either through providing written comment or providing public comment, when public hearings are scheduled. Your written or public comments regarding proposed rules improve our efforts in developing final rules.
Safety Net Rule Making Hearing Scheduled
On September 5, 2018, OSPI filed a Preproposal Statement of Inquiry (CR 101) to address possible rule making activity, which was followed by the CR 102 Hearing Notice on October 24, 2018. OSPI is considering amending WAC 392-140-600 through -685 regarding school district eligibility for state special education safety net funding to adopt recommendations from the Safety Net Legislative Workgroup. The rule making may also involve the addition of new definitions, a section on purpose and procedures for application and review, and technical and housekeeping revisions. The CR 101,
draft rules are available on OSPI's Rule Making web page, and contain details of the proposed changes and impacted WACs.
A hearing is scheduled for November 27, 2018 at 3 p.m. at OSPI. The hearing will start on time and will run until all those wanting to testify have done so, which means there is no specific end time, so testifiers should arrive by 3 p.m.
